Terms and Conditions

  1. Unless agreed otherwise in writing, contracts with a value over £10,000 (excluding VAT) will require a 20% deposit payable before filming begins. The remaining 80% will be invoiced on completion of the first draft of the video or multimedia project. Contracts with a value under £10,000 (excluding VAT) will be invoiced on completion of the first draft of the video or multimedia project or on the discretion of RKD Films.
  2. If the client cancels pre arranged filming on the day of filming for any reason they will be liable for a cancelation fee of £250 plus VAT.
  3. If payment is not received within 30 days of the invoice date, RKD Films will automatically charge interest at a rate of 8% above the Bank of England base rate per annum, which will be added to the customer’s account.
  4. On delivery of final product copyright will be transferred to the client, yet RKD Films will retain the right to use all approved footage for their own promotional purposes. This may exclude any third party material (e.g. music). Also RKD Films will endeavour to use copyright free library music for all productions unless directed from the client to use alternatives, which will require further charges and copyright approval.
  5. Any subsequent changes must also be provided in writing and then approved by RKD Films and may incur further cost.
  6. All feedback must be provided to RKD Films within 1 week  delivery of the first draft in order to make edit changes unless a prior arrangement has been agreed in writing, otherwise further charges may be incurred.
  7. A video programme will only be publicly released by RKD Films once the customer approves all content as complete and satisfactory and confirms this in writing or with verbal consent.
  8. A customer may terminate the contract at any time by written notice of termination. When a customer terminates the contract, they will remain liable to pay in full for all work previously undertaken and in progress by RKD Films unless any other written agreement is reached in advance.
  9. RKD Films reserves the right to refuse to use, publish or broadcast any information it considers obscene or morally unsuitable or which would breach copyrights, or which is libellous, defamatory or illegal.
  10. RKD Films cannot be held liable to any party for any errors on any medium after the customer has agreed in writing or verbally that the content is correct and accurate and should be posted, published or broadcast.
  11. E-mail correspondence shall be sufficient to prove changes to agreements for the form and content of programmes as long as it is acknowledged with a response.
  12. RKD Films will not commence work on any project until a signed purchase order or equivalent signed document has been provided by the client.
  13. Mobile videos or podcasts RKD Films provide are a promotional service and RKD Films are not responsible for any compatibility or data infringement issues. All clients must be aware and be responsible regarding compatibility issues with their customer’s devices and the client must be also aware of any other charges from network providers may apply and RKD Films are not responsible for this.
  14. RKD Films will be happy to liaise with your web team to deliver one web file to the requested specification which must be provided in writing.
  15. Any confidential or proprietary information acquired by RKD Films from a client company, person or entity will not be used or disclosed to any person or entity, except when required to do so by law. If required, RKD Films will sign and adhere to the conditions of any Confidentiality Agreement used by the client.
  16. Any confidential information which is acquired by the client company, person or entity regarding RKD Films must not be disclosed to any person or entity outside of the client company, except when required to do so by law or unless you have written approval from the Managing Director of RKD Films, in particular production budgets.
  17. Any contract requiring RKD Films to work to specific deadlines provided within the written agreement will be deemed to include a proviso the clients will make themselves reasonably available to communicate with RKD Films.  If RKD Films deem them not to of been so then RKD Films cannot be held responsible for failing to meet a deadline.
  18. RKD Films shall be under no liability if unable to carry out any provision of the contract for any reason beyond its control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, strike or other action taken by suppliers or owing to any inability to procure materials required for the performance of the contract.
  19. The client shall provide appropriate security arrangements for any filming outside of the United Kingdom for which RKD Films provides crew or equipment and such arrangements shall be notified to RKD Films in writing in advance of travel.
  20. RKD Films equipment will always be tested before a film shoot, but RKD Films cannot be held responsible for any camera or equipment malfunction during the shoot. In the likelihood of this rare event, RKD Films will replace the equipment. If this is not possible, RKD Films will offer to return at another scheduled time without charge.
